Understanding an SSDI Denial and Appeal Stages

A general overview of SSDI denial notices, reconsideration, hearings, Appeals Council review, and federal court.

An SSA denial notice explains the agency's reason, the available review procedure, and the deadline for that claim. The notice and current SSA instructions are the controlling sources.

Review Stages

Depending on the program and jurisdiction, review may include reconsideration, an ALJ hearing, Appeals Council review, and a federal court action. Each stage has its own scope and procedure.

SSA generally provides 60 days for many appeal requests and explains how it calculates receipt of a notice. Exceptions and good-cause questions are fact-specific.

Information on Appeal

The record may include updated medical evidence, functional information, work history, daily-activity statements, and procedural materials. Reapplying and requesting review can have different consequences for filing dates, issues considered, and possible past-due benefits.

Representation

Licensed attorneys and qualified non-attorney representatives may review the record, manage filings, and appear at a hearing. Fee arrangements and expenses should be confirmed in writing.
